The plaintiffs in the suit argued that the law unconstitutionally restricts speech and that it is overly vague. The Tennessee law was temporarily blocked by a federal judge for violating the First Amendment in April, just days before it was set to be enacted that injunction is set to expire May 26. A first violation of the law is a misdemeanor offense with a potential jail sentence of 11 months and 29 days subsequent violations are counted as felonies with a prison sentence of up to six years and a fine of up to $3,000. Tennessee recently enacted the nation’s first ban on drag performances, which prohibits “adult cabaret performances” (including drag shows) from taking place in public, or anywhere where they could be seen by a minor. ![]()
